That question is more important than it sounds. In a matrimonial dispute, memory becomes emotional, WhatsApp chats become scattered, relatives remember different dates and suddenly everyone has a different version of what happened.
A recent Calcutta High Court judgment gives husbands an important reminder about this.
In Arindam Ghosh & Others v. State of West Bengal & Another, decided on 11 September 2026, the wife alleged matrimonial cruelty and dowry-related harassment. The record showed that she had left the matrimonial home on 21 February 2021, while the criminal case was filed on 8 May 2024 — roughly three years later. The case included allegations under Sections 498A, 323, 354D, 506 and 34 IPC. The High Court ultimately quashed the proceedings against the husband, his mother and sister after examining the material before it.
Now, this does not mean that a genuine complaint becomes false merely because it is delayed. Nor does a husband automatically get a case quashed because he says, “It happened years ago.”
The practical point is different.

That same discipline matters when a husband wants to make a genuine complaint against wife. “She troubled me for years” is an emotion. Dates, documents and identifiable incidents turn that emotion into something that can actually be examined.
